there is a clear consensus in he.wikipedia that ויקיפדיה לנצח should be changed. You do not have the sole decision to poorly translate these messages. On the contrary. My actions on he.wikipedia were done with support by other sysops and community memebers, as was the english sysop who did the same thing in en.wikipedia. Image issue; Tal Brody

Perhaps someone with images expertise can help address this issue of the Tal Brody image? It is also used extensively by Hebrew Wikipedia. But seems to be about to be deleted--as a question has been raised as to whether Brody had rights to the image ... see the discussion of the image at the DYK here and at the image here.--68.173.108.123 06:52, 2 April 2011 (UTC)Reply

First of all, Tal Brody is not in a position to allow use of the photograph for the purposes of Wikipedia or the Commons. He is not the copyright holder, unless he bought the negative, which is unlikely. Secondly, it is unclear whether Tal Brody merely allowed using the photograph or gave permission for free usage. Thanks for the fast response. I'm not sure, with all due respect, that is quite right. If he was given the right to the copyright holder, he would have the right. If he gave his friend who accompanied him to the game his camera to take a photo of him, for him, he would be the copyright holder. If we AGF, we presume that one of those is the case. And if we AGF, we assume not only that the rights were as indicated, but that the use would be as indicated -- the standard wp free usage. That would all accord with the fact that for years all manner of media have used the same image, without attribution. BTW, I also see that on his official website he has photos from such games, bolstering the suggestion that AGF leads us to that he does indeed have rights to them one way or another.
All that aside, do you have any idea how to through Israel wp obtain any similar good photos, that could be used in the DYK? That would be great, of course.--68.173.108.123 07:17, 2 April 2011 (UTC)Reply
It is a little bit more complicated than that. As for copyrights - according to the relevant Israeli statute, the copyright holder is the person or organization that owns the negative. This statute is now repealed, but it was in force when the picture was taken. The copyright holder can give his rights away, but s/he needs to do it in writing. The fact that the copyright holder gave Tal Brody one of the copies s/he developed does not entail transfer of copyrights according to the law. Now, suppose Tal Brody does indeed own the copyrights, his permission must be clearer regarding the uses he allows. According to the law, a copyright holder can authorize usage without giving away his rights, he can give up some of his rights, he can give up all of them - all options are open to him. Therefore, in order to decide whether WP can use the image, there must be a detailed permission or reference to a standard document like those issued by Creative Commons. The Hebrew Wikipedia allows use of copyrighted images under "fair use" (another legal term, which means usage authorized by the law despite copyrights). Not all Wikimedia projects allow this, and in any case it is better to avoid it, because Wikimedia projects seek to be as free as possible, namely, that people could download texts and images and do with them whatever they like. A copyrighted image under "fair use" cannot be used freely. Dror_K 13:56, 2 April 2011 (UTC)Reply
Yes ... even more complicated than that. On reflection, it does not seem to me that Israeli law governs here. But if it does, I guess I am not seeing what in the law clarifies that it is insufficient for the cr holder to transfer the copyright with an unambiguous oral statement rather than a written statement, but I expect you have read the law in Hebrew and have the answer for that. The Israeli law demands that the transfer of copyrights (or waive of copyrights which is the equivalent of transferring the rights to any person at any place and in any time) be in writing. It doesn't matter whether it is a printed document, an email or any other medium, as long as there is a written statement that can be clearly attributed to the original owner of rights. I am not a lawyer, but the language of the Israeli law is very straightforward with regard to this issue. The Israeli law is applicable to artistic works created in Israel or by Israelis. If the picture was taken by an Israeli in a foreign country, both laws would apply, but a written statement from the photographer would be valid in almost all countries, so it should be enough.
