はじめに

ウィキメディア財団グローバル・アドボカシー担当※1は2022年5月にコミュニティと一連の対話を行い、コミュニティの参加者個々人を支援する人権の方針の最善のあり方について、ご意見を募集します。このページでは、人権の方針の背景を説明し、同方針に基づく財団のこれまでの取り組み実績、コミュニティ参加者がこの方針実施にどのように影響を与えるか情報を載せます。取り扱いにより注意を要する案件を対象にするには、規模を縮小し、より焦点をしぼり心を許せる状況を確保したフォーカスグループの設定も行います。今後、さらにコミュニティとの対話を実施する見込みです。(※:1=Global Advocacy team。)

これらの対話でもたらされた議論や勧告は、財団が今後の年月にどのように人権の方針に取り組むか、指針となります。 この過程を通して私たちのチームはこのページに示したこれらコミュニティとの対話について、記録を取り紹介された課題や勧告のまとめを提供します。

経緯

人権の方針は2021年12月8日に、ウィキメディア財団理事会によって承認されました。この方針はウィキメディア運動を促進し、全ての人 — 財団職員からボランティアの貢献者まで — の権利を尊重し保護する枠組みづくりに寄与し、権利擁護に関わる方針や技術について、範囲がもっと広い作業に方向性を示すもの(コンパス)として役立ちます。 重要点として、この方針は私たちの運動の参加者を守ため、人権を侵害するとちらつかせる国家主体ではない当事者や政府が示す要求や脅威にどのように対応するかを述べます。この方針の下、財団は次のことを約束します。(※=non-state actors)

  • 人権の影響評価を含めて引き続き定期的に人権のデューデリジェンスを実施するとは、権利保持者と日常に関与することに加え、人権に関するデューデリジェンスの趣旨として、私たち自身の操作やプロジェクトのあらゆる要素がどのように人権に影響するか自覚するためであって、巡りめぐって害の発生を緩和し防止することになります。
  • 人権への取り組みに見合うように、私たちの努力を追跡し公表することとは、私たちのウェブサイトやプラットフォーム全般の公的な透明性と公開性に関するより広範な取り組みの一部であり、それ専用の透明性のレポートの他に実施します。
  • 私たちが提携組織、民間セクターや政府に与える影響により、人権尊重を保ち促すこと。私たちだからこそ支援する立場にある権利、中でも情報のアクセスと共有の権利の確保について、ウィキメディア運動戦略※1に記したグローバルなアドボカシーの活動※2を増やす取り組み※3は、これらの努力を反映させ、実現します。(※:1=Movement Strategy。2=global advocacy activities。3=committment。)

コミュニティとの対話

この方針はウィキメディア財団にウィキメディア運動に関わるすべての人の人権を保護し尊重するよう求めます。この方針をどのように実施するか、それは究極的にはこのコミュニティの参加者の役に立つことです。ウィキメディアのコミュニティの皆さんにとって、この方針が最善の働きをするとはどのような状態か理解するため、グローバル・アドボカシー・チームではコミュニティとの一連の対話を呼びかけて、直接、個々人から話を聞く機会を設けているところです。

趣旨

ウィキメディアのコミュニティの皆さんにとってコミュニティとのこれら一連の対話は、財団が人権方針をどのように実施するとよいかをめぐり、重要なインプットとフィードバックを提示する機会です。これら対話には次の目標があります。

  1. ウィキメディア運動に関わったり作業したせいで、皆さんの人権がすでにどのような影響を受けているか、財団がより的確に理解するため。
  2. 皆さんやコミュニティの他の人の人権が脅かされた時、財団がどのようにもっとよく対応できるかについて、着想や提案、勧告を集めるため。

グローバル・アドボカシー・チームでは人権とは世界のどの地域でも脅かされていると理解しています。これら対話の趣旨として、私たちのコミュニティに迫るうち、最も緊急性を要する、ゆゆしい人権侵害に焦点を当てます。

実施方式と参加登録

これらの対話は Zoom(ズーム)経由で実施し、各回60分とします。財団の代表が冒頭の挨拶と情報更新を行い(10分)、残り時間(50分)はコミュニティの皆さんを交えて方針の実施策の形成を助けてもらいます。実施回への参加登録は、下記の表内のそれぞれのリンクをクリックしてください。これら対話にはウィキメディアの友好的であるべき空間の方針なら日にユニバーサル行動規範によって規定されます。対話に参加される皆さんには事前の準備と、まとまりのある着想や勧告を共有されるようお願いします。では、以下のリンクをクリックしてご参加を!

  5. 知識の公平さの限界とは、情報バイアスや個別の差別事案としてジェンダー不平等や人種や民族や地理的グループの声の届きにくさを反映している場合があります。

注記:上に述べた人権の影響評価は、今後、公開の予定です。

これらの対話の枠組みとなる質問

各回の対話の進行役はグローバル・アドボカシー班が務め、洞察に満ちた生産的な会話を介して、コミュニティの皆さんの人権についてよりよく理解することを目指し、どのような影響があり、将来的に同様の状況が発生した場合、財団はどのようにすると、もっと良い支援ができるか検討します。これらの対話に先駆けて、以下の質問を想定してみてください。

  • 有害なコンテンツ、嫌がらせ行為あるいは政府の取り調べおよび/または検閲がウィキメディアのいずれかのプラットフォームで実施され、皆さんのコミュニティが害を受けたことはありますか?
  • その不正行為は予測が可能でしたか? それを緩和する方法はあり得たでしょうか?
  • 皆さん自身または知人で、不正行為が起こる予兆や実際に発生したときにウィキメディア財団に連絡した人はいませんか?
  • 財団は皆さん自身または皆さんのコミュニティをどれくらい支援して来ましたか? 有効だったこと、改善が必要なこととは?
  • そのような不正行為の繰り返しや、皆さんのコミュニティで他の人に影響しないようにするには、どんな予防方法がありますか?
  • 不正行為ではないかと気づいた時、その懸念を財団にどのように伝えたらよいか、方法はお分かりですか?
  • 皆さんのコミュニティでは固有のどんな問題に直面していますか?

Summary of Community Conversations

Latin America

  • Online Harassment: Volunteers shared experiences being harassed online, both on and off-wiki; these volunteers noted that when writing about politically sensitive or socially controversial topics, they can be targeted by journalists or others who take issue with their content; another volunteer added that political polarization in the region contributes to this challenge; Volunteers expressed that they frequently don’t know how to deal with these challenges and need support.
  • Privacy: A volunteer elaborated on the issue of harassment and noted that if a Wikimedian has been active long enough, there is likely enough information about them online that an astute person could infer their identity, share it publicly, and begin to target them for their work; this is particularly problematic on Commons, where removing your own content is extremely difficult; a process should exist to remove your own information.
  • Community Recommendation: Volunteers recommended that resources and training be made available for them to better protect their own human rights; training would be helpful for the broader community to understand what human rights are impacted online and on-wiki, and how they can respond and access resources when they are threatened.

Asia

  • Doxxing: Volunteers shared experiences about cased of doxxing that bled over into Twitter and other off-wiki platforms; one volunteer was (mistakenly) told WMF could not help since it was not occurring on a WMF platform; WM staff recommended users contact talktohumanrights@ in such situations, and the Human Rights team will provide what assistance they can
  • Takedown Requests: A volunteer inquired about takedown requests, whether it has happened, and how the Foundation responds; WMF staff pointed to the Transparency Report and legal review process; a BoT member discussed a case where a page’s edit history was removed in an extreme situation to protect users.
  • Due Diligence/Events and Conferences: a volunteer inquired about taking into consideration human rights concerns in some countries as communities work to plan an in-person event; WMF staff affirmed that the HRP commits the Foundation to conducting due diligence and supporting communities to carry our due diligence around event planning could be a productive area of collaboration and co-design in the near future.
  • Contacting the Foundation on Human Rights Concerns: multiple volunteers inquired about contacting the Foundation around human rights concerns or threats, noting certain situations can be scary. WMF staff encouraged them to reach out to the Human Rights Team through whichever channels they felt most secure with for assistance, noting that details are kept private for security. The team can also support volunteers with digital security training, analyzing risks, and minimizing the amount of their information that is publicly available.

Africa

  • Government Surveillance: A volunteer inquired if the Foundation can detect government surveillance; another volunteer shared that they cannot edit certain Wikipedia articles for fear of government surveillance and possible retribution, while another shared how his affiliate group is a legally registered NGO that is, therefore, subject to government monitoring of its activities; WMF staff explained that detecting surveillance is difficult but many governments to carry our mass surveillance, but that the Foundation does advocate for such surveillance be narrow and lawful.
  • Legal Defense of Volunteers: A volunteer inquired about the Foundation providing legal defense to individual volunteers; WMF staff explained that such cases are evaluated on a case-by-case basis, but we do advocate for intermediary liability protections and work with local communities and partners to mitigate such situations.
  • Disinformation: A volunteer shared that “edit wars” and disinformation can become significant challenges in their community around elections; neutral volunteers want to address such disinformation, but do now know how; WMF staff highlighted our growing work to address disinformation on WMF platforms and that the Foundation hopes to provide training to volunteers.

Central & Eastern Europe

  • Doxxing: WMF staff shared that this has been the most frequent challenge in the region in recent weeks, including cases in which volunteers’ information was shared via Telegram; one volunteer who was doxxed was arrested; volunteers should reach out to the Human Rights team to flag any cases of doxxing and channels through which it is occuring; the Human Rights team can also provide digital security best practices and recommendations on what to do if an individual is being doxxed.
  • Foundation Commitment to Human Rights: the armed conflict in Ukraine is an extreme situation which touches so many parts of the Foundation, including grant making, trust and safety issues, technology, product, etc.; in such situations the BoT supports the Foundation in taking extraordinary steps to support affected volunteers, staff, and contractors that goes beyond what is normally done; this support can’t always be made public for security reasons, but the community can always share what their needs are.
    • A volunteer inquired about the best way to stay in contact on these matters; WMF staff explained that volunteers can contact the Human Rights team 24x7 through a variety of channels, using whichever they feel most comfortable with.
  • Government Censorship: A volunteer raised the topic of the Turkish government blocking Wikipedia in 2017 and inquired about Foundation communications to the community in such situations; WMF staff explained that the Foundation communicated what they could at the time and that, in some situations, sharing information can make the situation worse; WMF staff also explained the process for reviewing takedown requests from governments and pointed towards the Foundation’s Transparency Report.
  • Community Recommendation: A volunteer recommended a central hub be established where resources and information can be made available to them.
