Correspondence with French institutions edit

Plusieurs demandes ont été faites auprès d'institutions françaises pour obtenir des autorisations de publication pour Wikipédia, notamment auprès de la Bibliothèque nationale de France, et des Archives photographiques du Ministère de la Culture.

Dans le premier cas, il s'agit d'enluminures qui ont plusieurs siècles. La BNF autorise la reproduction, mais apparemment uniquement avec des restrictions, ce qui voudrait dire qu'elle n'admet pas que ces documents sont du domaine public.

Dans le second cas, il s'agit de photos du XIXe siècle dont la Société des auteurs dans les arts graphiques et plastiques ainsi que les "Monuments historiques" refusent toute publication sans paiement de droits d'auteur.

Several requests were made to French institutions to obtain authorization for the publication of documents in Wikipedia. Institutions contacted include the National Library of France and the photographic archives of the French Ministry for Culture.
In the first case, these are illuminations which are several centuries old. Although the National Library of France authorized the reproduction, they did so only with restrictions. They would not admit that these documents are in the public domain.
The second case concerned 19th century photographs for which the ADAGP and those responsible for historic monuments refuse any publication without the payment of royalties.

Decision of the Supreme Court of Appeal edit

Le 15 mars 2005, la Cour de Cassation, la plus haute juridiction française, a rendu un arrêt très intéressant dans le domaine du droit d'auteur. Elle a débouté les artistes Daniel Buren et Christian Drevet qui sont les auteurs du réaménagement de la place des Terreaux, à Lyon. Ils reprochaient à quatre éditeurs d'avoir reproduit et commercialisé des cartes postales de la place sans leur autorisation et sans mentionner leur nom au verso des cartes.

On March 15, 2005, the Court of Cassation, the highest jurisdiction in France, handed down a very interesting judgment in the field of copyrights. It nonsuited the case of artists Daniel Buren and Christian Drevet, who designed the renovation of Place des Terreaux in Lyon. They reproached four editors for having reproduced and marketed postcards of the square without their authorization and mention of their name on the back of the cards.

The opinion of the President of the French Republic edit

Le Président de la République française est récemment intervenu auprès du Ministère de la Culture, pour « accélérer la diffusion des oeuvres françaises et européennes sur Internet ». Il a notamment demandé « d'analyser les conditions dans lesquelles les fonds des grandes biblothèques en France et en Europe pourraient être rendus plus largement et plus rapidement accessibles sur Internet ».

The President of the French Republic recently intervened with the Ministry for Culture, asking to accelerate the distribution of French and European works on the Internet. He particularly asked for an analysis of the conditions under which the funds of the large libraries in France and Europe could be increased and the works made more easily accessible on the Internet.

Il serait intéressant de voir comment cette initiative pourrait bénéficier aux projets de Wikimedia Foundation.

The Michael Project edit

Par ailleurs, trois pays européens, le Royaume-Uni, l'Italie et la France se sont associés pour créer un portail Internet « recensant l'ensemble des collections culturelles ». D'autres pays devraient rejoindre le projet prochainement. L'Allemagne, la Belgique, la Finlande, la Grèce, la Hongrie, l'Irlande, Malte, les Pays-Bas, la Pologne et le Portugal ont fait savoir qu'ils souhaitaient avoir leur place sur Michael.

Furthermore, three European countries - the United Kingdom, Italy and France - joined to create an Internet portal to display cultural collections. Other countries are expected to join the project soon. Germany, Belgium, Finland, Greece, Hungary, Ireland, Malta, the Netherlands, Poland, and Portugal have all expressed an interest in joining the Michael Project.

Il serait aussi utile de commencer une campagne de lobbying pour demander à ce qu'une licence libre ou une mise dans le domaine public soit choisie aussi souvent que possible pour la diffusion numérique des œuvres, en particulier pour celles produites par des agents des administrations publiques, dans le cadre de leur fonction, comme c'est le cas pour certaines administrations aux États-Unis (mais pas toutes : en particulier les administrations des États et les municipalités peuvent protéger leurs productions intellectuelles par copyright) (cf. photo de la NASA et des autres administrations fédérales américaines) et en respect des autres problèmes de droit et pour conterbalancer l'américanisation des contenus disponibles librement en ligne.

There is a proposed bill in the course of adoption by the French Parliament, which was adopted by the Council of Ministers on November 12, 2003. This says the title II tends to expressly recognize with the public agents the quality of author for the works carried out within the framework of their functions. The device considered aims at ensuring the effectivity of the recognition of the royalty while guaranteeing the administration which employs them the means of ensuring its mission of public service.

Dans un premier temps, il faudrait profiter des sentiments nationaux pour demander la publication de certains documents sous licence libre (par exemple, les photos des Présidents de la République française). Ensuite, on pourrait élargir le champ d'action à d'autres types de documents.
