De juridiska frågorna kring upphovsrätt som gäller för Wikipedia bör diskuteras noggrant innan något större projekt som, exempelvis en upphovsrättsrobot, inleds.

Grunder

Wikimedia Foundation har fastställt flera principer som alla projekt är skyldiga att följa:

  • Endast fritt innehåll är tillåtet, all text licensieras under en dubbellicens med Creative Commons Attribution Share-Alike och GNU Free Documentation License (några undantag finns,exempelvis Wikinews som använder Creative Commons Attribution)
  • Alla bilder antingen fri (allmän egendom, GFDL, CC eller motsvarande) eller om lokal policy tilåter det, uppladdad som fair use, se nedan.
    • Alla mediefiler måste förses med en giltig licensinformation och källa för att kunna verifieras.
    • Allt innehåll som inte är fritt skall ha detaljerade bestämmelser kring användningen.

Moral rights are a part of CC 3.0 licenses, allowed on Commons.

Non-acceptance of the Rule of the shorter term

Because United States law does not recognize the "Rule of the shorter term", meaning content that should be in the public domain in the United States (but is the case in its source country), has to be judged alongside the United States' complicated rules for the public domain, and can potentially not be usable on Wikimedia projects.
